A HOTEL was forced to end its plan to play loud music after neighbors complained it would ruin their night’s sleep.

The Norwood Payneham & St Peters Council Development Review Panel last week rejected a request by the owners of the Kensington Hotel to allow bands and DJs to play amplified music at the Regent St.

Currently, the pub, better known as The Kensi, is limited to background music and performances by unaccompanied pianists, singers and guitarists.

The panel, which debated the issue for nearly 90 minutes, said the music would disturb nearby residents and could not guarantee that the hotel would meet development conditions such as closing all windows and doors when the music is played.

A “verbal stoush” between pub management and residents followed the meeting, according to Mr. Sam McInnes, general manager of the Hurley hotel group, owner of the Kensi.

Mr McInnes said he was “shocked” by the decision because the hotel wanted to support local musicians and entertain guests.

“The problem is perception and reality,†Mr. McInnes said.

“There is a perception that we are going to interfere with the enjoyment of people in the area, but there is no way we can have a group of three musicians playing there.

“We would probably only have an amplified acoustic guitar and a singer – that would be the most common.”

Since 1999, the hotel has not been able to host bands, function as a nightclub, pump heavy metal or rock, and can only play easy-to-listen music.

The new proposal would have allowed the hotel to play music up to 97 dB, which is the sound of a jackhammer or lawn mower.

The staff at the Kensington Hotel should have used a sound level meter to monitor the noise level.

Ten residents near the hotel, some of whom attended the meeting, complained about the proposal.

Resident Judy Carman said neighbors wouldn’t be able to sleep if louder music was introduced.

“And that’s just the sound of the band. Then there are people clapping, clapping, stamping their feet and shouting in encouragement, â€said Dr. Carman.

Resident Keith DeGiglio, who represented five neighbors, said allowing music would only worsen noise issues.

“My partner and I have moved three times already due to the impact of noise from customers,†said DeGiglio.

“The developer app doesn’t give us the necessary level of confidence in handling live music.

Panel member Kevin Duke said at the meeting that he was unsure how the coziness of the area would be maintained with louder music.

“I have great sympathy for the operators who want to have a business activity there, but also for the residents who have bought in the area and who do not want to see the amenities reduced in any way,†said Mr. Duke.

Panel member Phil Smith understood hotel management wanted more flexibility, but worried that conditions, such as closing all windows and doors, were not being followed properly.

Mr. McInnes was unsure whether he would appeal the decision.

Over the past few weeks, concerns from Community Watch, Morgan Williams of the Tyler County District Attorney’s Office, and Deputy Don Calhoon of the Tyler County Sheriff’s Office have made their way to the Representative’s Office. State James White.

He explained that the purpose of the transition center was to provide a place for parolees who have nowhere to go when they get out of prison. After Edward’s brief introduction, Community Watch members posed their questions.

The questions ranged from “Why put the facility in Dam B?” Where do you expect residents to work? How will residents be transported to work and other functions?

“How can bringing people into a community that has been known in the past for drugs and other issues be a place that would be a good fit for a halfway house?”

As the questions continued, the atmosphere became more tense, especially as Edward said that many of the group’s questions were unanswered because the RJMFC Board of Directors did not. had not fully discussed all the details and needed clarification on some issues from the TDCJ Parole Division.

Edward’s responses did little to appease the Community Watch members who were present. Community Watch contacted RJMFC over two years ago once they were made aware of the possibility of a halfway house.

Community Watch asked representatives to come to a meeting and submitted questions that Community Watch members wanted answered.

There were several attempts to invite RJMFC to meetings by the Dam B group and no response was ever received other than to decline the invitation. Thursday night’s meeting was the first time an RJMFC representative has appeared or responded to Community Watch.

There were also questions about people claiming to raise funds on behalf of the RJMFC group. They pretended to be the management of the establishment.

Edward knew nothing of the actions of these individuals and repeatedly stated that neither had the authority to represent RJMFC. Questions about vetting these and other volunteers have been raised.

Several people were visibly upset to believe that these individuals were in fact associated with the RJMFC and the halfway house.

Edward invited Community Watch members to the next meeting of the RJMFC Board of Directors which is scheduled for January 22 at noon at the Dam B facility.

Edward concluded the meeting by saying, “RJMFC will not be filing its petition with TDCJ until everything is settled and all community concerns are resolved.”

KUALA LUMPUR (May 11): Businessman Datuk Habibul Rahman Kadir Shah has filed a motion to strike a counterclaim by Syed Saddiq Syed Abdul Rahman, claiming the counterclaim was an abuse of legal process.

Reports had indicated that Syed Saddiq, who was then Bersatu’s youth leader, had also alleged that there had been a “systematic” attempt to influence Bersatu leaders to leave the party.

Habibul is suing Syed Saddiq because he believed the latter referred to him as one of the party leaders who threatened and bribed.

Habibul is a former adviser to ex-Prime Minister Datuk Seri Najib Razak.

Previously, Syed Saddiq, in his defense against the lawsuit, cited the defense of justification, qualified privilege and fair comment.

In Habibul’s request that was spotted by peak markets, Syed Saddiq allegedly uttered those words maliciously to tarnish and hurt the former’s reputation in public.

Habibul also said that Syed Saddiq had no right to use the argument of qualified immunity in this case because the latter’s statements were “baseless” and “without public importance”.

“The words spoken in 2017 were for his own (Syed Saddiq) political gain,” the app reads.

Habibul also said that Syed Saddiq cannot stick to the fair comment argument because his comments were not based on facts and were only meant to “satisfy his anger, displeasure and malice towards him. (Habibul)”.

“Plaintiff (Habibul) declares that Respondent’s comments were not told in truth or with good intentions or with verification of facts,” reads the request.

“Furthermore, the plaintiff argues that the defendant’s counterclaim may impair, obstruct or delay the fair conduct of the action (the defamation action),” Habibul argued.

According to Syed Saddiq’s lawyer, Lim Wei Jiet, the counterclaim has been filed in court and the handling of the case has been set for July 21.

The motion to strike the counterclaim was filed by the law firm Jahaberdeen and Co.
